www.cookingsan.com (hereinafter the “Site”) is published by Japazon Co., Ltd (hereinafter the “Company” or “We” or “Our”), a single-shareholder joint-stock company with a share capital of 5,000,000 Yen, incorporated under the Companies Act of Japan, whose registered office is located at Sumida-Ku, Sumida 2-9-3, 131-0031 Tokyo, registered with the Tokyo Commercial Register under number 0115-01-024812, and represented by Xavier Dussailly, acting as manager.

In the course of its activity of publishing and managing the Site, the Company collects and uses information relating to you (hereinafter the “Personal Data”).

The protection of your Personal Data is essential to the Company. Therefore, the Personal Data that you entrust to the Company are processed in full compliance with the applicable regulations, in particular the regulations relating to the protection of personal data applicable within the European Union since May 25, 2018¹.

As part of its commitment to protecting your Personal Data, the Company wishes to inform you transparently, in particular, about:

  • The reasons why and the way in which it collects, uses and stores your Personal Data;

  • Its role in the processing of your Personal Data; and

  • Your rights and its obligations with regard to the processing of Personal Data.

1. What is the purpose of this Privacy Policy?

This policy applies to all uses of your Personal Data carried out by the Company (hereinafter the “Processing”).

Its purpose is to inform you of the manner in which your Personal Data are processed by the Company, which is the entity responsible for the Processing of Personal Data.

2. What types of Personal Data do we collect?

The Personal Data collected by the Company about you are provided directly by you through the Site.

The provision of Personal Data is a necessary condition for the preparation and delivery of your order or for sending a newsletter when you have subscribed to this service.

In particular, this includes the following information:

  • First and last name;

  • Address;

  • Date of birth;

  • Email address;

  • Telephone number;

  • Credit card data.

In order to ensure that your Personal Data are relevant, accurate and up to date, the Company may ask you to review and confirm the accuracy of the Personal Data it holds about you. The Company also asks you to inform it of any changes relating to your Personal Data.

3. When do we collect your Personal Data?

Your Personal Data are collected by the Company:

  • When creating a customer account;

  • When placing an order for a product;

  • When subscribing to the newsletter;

  • During your use of the Site (in the form of cookies).

4. On what legal basis and for what purposes do we process your Personal Data?

4.1. Purposes of the Processing

We always process your Personal Data for a specific purpose and only process the data that are necessary to achieve that purpose.

In particular, we process your Personal Data for one or more of the following purposes:

  • Operation and optimization of the Site;

  • Preparation and shipment of orders;

  • Management of newsletter subscriptions;

  • Provision of after-sales service;

4.2. Legal basis of the Processing

We are not authorized to process your Personal Data without a valid legal basis.

Accordingly, we process your Personal Data solely in order to perform our contractual obligations towards you or for our legitimate interests.

We do not carry out any automated decision-making, including profiling, that could produce legal effects concerning you or significantly affect you.

5. Who has access to your Personal Data?

5.1. Within the Company

We disclose your Personal Data to the employees and managers of the Company, insofar as such data are necessary for the performance of their duties.

5.2. Outside the Company

We also transfer your Personal Data to third parties external to the Company for the purposes set out in Section 4.1, provided that such third parties need these data to perform the tasks entrusted to them for the operation of the Site or the preparation of your order. We do not transfer your Personal Data to these third parties for commercial purposes without your prior express consent.

These third parties include:

  • Delivery service providers, for the purpose of delivering products purchased on the Site;

  • Any national or international authority when we are legally required to disclose such data.

6. How do we protect your Personal Data?

Access to your Personal Data is granted only to employees and/or managers of the Company who need it to perform their duties.

All such employees and managers are subject to strict obligations regarding the protection and confidentiality of Personal Data.

The Company has also implemented appropriate technical and organizational measures to protect Personal Data against destruction, loss, alteration, unauthorized disclosure of Personal Data transmitted, stored or otherwise processed, or unauthorized access, whether accidental or unlawful.

7. How long do we retain your Personal Data?

We retain your Personal Data for the period necessary for the intended Processing, in accordance with applicable legal requirements.

Data are retained for a period that does not exceed what is necessary for the following purposes:

  • Order execution: Data necessary for processing your request are retained for a maximum period of three years from your last order or our last contact.

  • Newsletter: Your data are retained for as long as your subscription remains active. You may unsubscribe at any time using the link provided.

8. What are your rights regarding your Personal Data and how can you exercise them?

8.1. Your rights

You have the right to access the Personal Data processed by the Company that relate to you. If you believe that any information we hold about you is inaccurate or incomplete, you may request that it be corrected. The Company will promptly correct such information.

You also have the right to:

  • Request the erasure of your Personal Data; in this case, we will carry out the requested erasure without delay, subject to compliance with legal and regulatory obligations requiring us to retain certain Personal Data;

  • Request the restriction of the Processing of your Personal Data;

  • Request the portability of your Personal Data, meaning the transmission by the Company to a third party of the Personal Data it holds about you in a structured, commonly used and machine-readable format.

You also have the right to object to the Processing of your Personal Data.

8.2. Exercising your rights

To exercise the above rights, you may send an email to contact@cookingsan.com, together with a copy (front and back) of your identity card or passport, so that we can verify your identity.

The Company will respond to such requests or objections in accordance with the applicable regulations.

8.3. Complaint to a data protection authority

You may also lodge a complaint with the personal data protection authority of (i) your habitual place of residence, (ii) your place of work, or (iii) the place where the alleged infringement occurred.

9. Changes to this Privacy Policy

This policy may be subject to changes. Any modification in the way your Personal Data are processed will be communicated to you through the communication channel we usually use to contact you.
